Inquiry into adoptions in the Congo: the District Anti-Mafia Directorate denies the previous head of Boccassini and declares the "total groundlessness of the crime report". Last Friday, during the hearing in the council chamber before the judge for preliminary investigations Sofia Fioretta, the public prosecutor of the Milan anti-mafia district directorate, Giovanna Cavalleri, declared by surprise the "total groundlessness of the crime" and reiterated the request filing the investigation against AIBI, which was registered in the register in 2017 for a series of alleged serious events including criminal association, aiding illegal immigration and corruption.
The statement put on record by the prosecutor of the prosecution is a novelty in the proceedings: in the investigative proceedings signed by the former head of the Antimafia, Ilda Boccassini, by the public prosecutor Paolo Storari and by Cavalleri himself and in the documents with which the Rome Public Prosecutor had transmitted the file for territorial jurisdiction in Milan had never been found the total groundlessness of the crime, if anything the opposite.
After a first verification of the facts by the mobile team of the police headquarters, the Milanese Public Prosecutor had in fact requested authorization to intercept the telephone of Marco Griffini. And in their request, the same magistrates coordinated by the deputy prosecutor Boccassini had written: "In light of the above reconstructed, an extensive indicative picture emerges unequivocally concerning the existence of a criminal association in San Giuliano Milanese - where it has the legal headquarters of the Aibi association - which would operate in Italy and partly in the different countries of origin of the minors then subject to adoption ... The events reconstructed above with reference to all the issues arising in the adoption procedures of Congolese children, believe that the reported - and established - "irregularities" may constitute the usual modus operandi of the association ... can only raise more than a few suspicions that behind these passages of money we can hide ... the price of what it could become a real trade of minors ".
The request for wiretapping, considered "absolutely essential for the purpose of prosecuting the investigations", had however been rejected by the judge Fioretta, according to which the investigation could "be adequately continued and developed through the hearing of the numerous persons concerned (and already identifiable on the basis of the documents transmitted) ".
No offended party, adoptive parents and adopted children, however, has never been heard by the prosecutor. A leak of information from the judge's office, which mistakenly informed the top management of Aibi of the investigations in progress five months before the expiry of the terms of the law, then compromised the confidentiality of all the work of the District Anti-Mafia Directorate then directed by Ilda Boccassini. At this point at the beginning of 2018 the magistrates, without being able to use the interception tool and with the confidentiality of the investigation now violated, have requested archiving. But even in that phase they never declared the total groundlessness of the crime.
According to the public prosecutor Cavalleri, who signed the request alone, the file was instead closed because, without the instrument of wiretaps, "nothing in the file allows us to recognize further, profitable, investigative activities that can offer elements for the continuation of the same or , in any case, that they can provide a comparison of the hypotheses of crime already formulated ... »and because« the elements acquired during the investigations are not, for the above mentioned remarks, suitable to support the accusation in court and that, however, no space left for further investigative investigations ".
At the time there was no mention of groundlessness in the documented denunciations of adoptive parents and their children. Today, however, without further investigations, the Milan prosecutor's office after listening to the suspects' version aligned itself with the defense of Aibi, represented by the lawyers Stefano Guarnaschelli of Pavia and Enrica Dato of Catania. With these premises, which see total public accusation and defense, the judge Sofia Fioretta will deposit the provision for filing by hours.
The lawyer of the adoptive parents, Alessio Sangiorgi, who replaced his colleague Francesco Rosi absent for legitimate impediment, pleaded the nullity of the proceedings before the judge for "lack of notice of both the request for filing and the setting of today's chamber hearing, with reference to four subjects (two couples of spouses) that refers to being offended persons of the crime of mistreatment of minors ". Both the public prosecutor and the defense of Aibi have obtained the rejection of the exception presented by the offended party. The lawyer Sangiorgi did not consider the courtroom hearing any longer valid. New appeals are expected.
The summits of Aibi come out so completely "innocent" from the long proceeding that concerned them. The magistrates' provision leaves unanswered reports of about fifty children, adopted in Italy by the Democratic Republic of the Congo through the San Giuliano Milanese institution: children who have declared that they do not recognize themselves in the identity and in some cases even in the written names in the sentences of adoption issued by the judicial authority of that country. Some of them have also revealed that they have been tricked away from their natural families, as was reported by a police officer and a marshal of the carabinieri and then transmitted to the judicial authorities in a long statement signed by the then vice president of the Commission for international adoptions, the magistrate Silvia Della Monica: very serious facts that now, according to the Milan anti-mafia prosecutor's office, are totally unfounded and that from today, unless new, they will no longer be linked to the activity of Marco Griffini and of his family members.

Marco Griffini, 71 anni, la moglie Irene Bertuzzi, 69, e la loro figlia Valentina Griffini, 36 anni, rispettivamente presidente, amministratore delegato e responsabile delle operazioni in Africa dell'ente autorizzato dal governo “Aibi – Amici dei bambini”, secondo la Procura di Milano non hanno commesso reati nelle procedure di adozione con la Repubblica Democratica del Congo.
Venerdì scorso, durante l'udienza in camera di consiglio davanti al giudice per le indagini preliminari Sofia Fioretta, il pubblico ministero della Direzione distrettuale antimafia milanese, Giovanna Cavalleri, ha dichiarato a sorpresa la «totale infondatezza della notizia di reato» e ribadito la richiesta di archiviazione dell'inchiesta contro Aibi, che era stata iscritta a registro nel 2017 per una serie di presunti gravi fatti tra cui associazione per delinquere, favoreggiamento dell'immigrazione illegale e corruzione.
La dichiarazione messa a verbale dal magistrato della pubblica accusa è una novità nel procedimento: negli atti delle indagini firmati dal precedente capo dell'Antimafia, Ilda Boccassini, dal pm Paolo Storari e dalla stessa Cavalleri e nei documenti con cui la Procura di Roma aveva trasmesso il fascicolo per competenza territoriale a Milano non era mai stata riscontrata la totale infondatezza della notizia di reato, semmai il contrario.
Dopo una prima verifica dei fatti da parte della squadra mobile della questura, la Procura milanese aveva infatti chiesto l'autorizzazione a intercettare il telefono di Marco Griffini. E nella loro richiesta, gli stessi magistrati coordinati dal procuratore aggiunto Boccassini avevano scritto: «Alla luce di quanto sopra ricostruito, emerge in modo inequivocabile un corposo quadro indiziario relativo all'esistenza di un'associazione per delinquere realizzata a San Giuliano Milanese – ove ha sede legale l'associazione Aibi – che risulterebbe operare parte in Italia e parte nei diversi Paesi di origine dei minori poi oggetto di adozione... Le vicende sopra ricostruite con riferimento a tutte le problematiche emerse nelle procedure di adozione di bambini congolesi, inducono a ritenere che le segnalate – e accertate - “irregolarità” possano costituire l'abituale modus operandi dell'associazione... non può che suscitare più di qualche sospetto che dietro a tali passaggi di denaro si possa celare... il prezzo di quello che potrebbe divenire un vero e proprio commercio di minori».
La richiesta di intercettazioni, ritenuta «assolutamente indispensabile ai fini della prosecuzione delle indagini», era stata però respinta dal giudice Fioretta, secondo la quale l'inchiesta poteva «essere adeguatamente proseguita e sviluppata attraverso l'audizione delle numerose persone interessate (e già individuabili in base agli atti trasmessi)».
Nessuna parte offesa, i genitori adottivi e i bambini adottati, comunque è mai stata sentita dalla Procura. Una fuga di notizie dell'ufficio del giudice, che per errore ha informato i vertici di Aibi delle indagini in corso con cinque mesi di anticipo rispetto alla scadenza dei termini di legge, ha poi compromesso la riservatezza di tutto il lavoro della Direzione distrettuale antimafia allora diretta da Ilda Boccassini. A questo punto a inizio 2018 i magistrati, senza poter utilizzare lo strumento delle intercettazioni e con la riservatezza dell'inchiesta ormai violata, hanno chiesto l'archiviazione. Ma nemmeno in quella fase hanno mai dichiarato la totale infondatezza della notizia di reato.
Secondo il pm Cavalleri, che firmava da sola la richiesta, il fascicolo andava invece archiviato perché, senza lo strumento delle intercettazioni telefoniche, «nulla in atti consente di ravvisare ulteriori, proficue, attività di indagine che possano offrire elementi per la prosecuzione delle stesse o, comunque, che possano dotare di riscontro le ipotesi di reato già formulate...» e perché «gli elementi acquisiti nel corso delle indagini non siano, per i rilievi sopra esposti, idonei a sostenere l'accusa in giudizio e che, comunque, non residuino spazi per ulteriori approfondimenti investigativi».
Allora non si parlava di infondatezza nelle documentate denunce dei genitori adottivi e dei loro bambini. Oggi invece, senza ulteriori attività di indagine, la Procura di Milano dopo aver ascoltato la versione degli indagati si è allineata alla difesa di Aibi, rappresentata dagli avvocati Stefano Guarnaschelli di Pavia ed Enrica Dato di Catania. Con queste premesse, che vedono in totale sintonia pubblica accusa e difesa, il giudice Sofia Fioretta depositerà a ore il provvedimento di archiviazione.
Il legale dei genitori adottivi, Alessio Sangiorgi, che sostituiva il collega Francesco Rosi assente per legittimo impedimento, ha eccepito la nullità del procedimento davanti al giudice per «mancanza dell'avviso sia della richiesta di archiviazione, sia della fissazione dell'odierna udienza camerale, con precipuo riferimento a quattro soggetti (due coppie di coniugi) che si riferisce essere persone offese del reato di maltrattamenti di minori». Sia il pubblico ministero sia la difesa di Aibi hanno ottenuto il rigetto dell'eccezione presentata dalla parte offesa. Non ritenendo più valida l'udienza in camera di consiglio, l'avvocato Sangiorgi ha abbandonato l'aula. Si prevedono nuovi ricorsi.
I vertici di Aibi escono così completamente "innocenti" dal lungo procedimento che li ha riguardati. Il provvedimento dei magistrati lascia senza risposte le denunce di una cinquantina di bambini, adottati in Italia dalla Repubblica Democratica del Congo attraverso l'ente di San Giuliano Milanese: bambini che hanno dichiarato di non riconoscersi nell'identità e in qualche caso perfino nei nomi scritti nelle sentenze di adozione emesse dall'autorità giudiziaria di quel paese. Alcuni di loro hanno anche rivelato di essere stati sottratti con l'inganno alle loro famiglie naturali, come è stato riscontrato da un funzionario di polizia e da un maresciallo dei carabinieri e poi trasmesso all'autorità giudiziaria in una lunga informativa firmata dall'allora vicepresidente della Commissione per le adozioni internazionali, il magistrato Silvia Della Monica: fatti gravissimi che ora, secondo la Procura antimafia di Milano, sono totalmente infondati e che da oggi, a meno di novità, non potranno essere più collegati all'attività di Marco Griffini e dei suoi familiari.
