The Milan Public Prosecutor has definitively closed the proceeding initiated by the previous Cai management (International Adoption Commission) against Aibi, one of the most important institutions authorized for adoptions , for a series of serious irregularities concerning the adoption procedures in Congo. In practice, Aibi was accused of getting the green light for adoptions by the authorities of the African country behind the payment of bribes.

The minors, according to the charges made by the Cai to the Milanese institution, would have been taken away from the families of origin, imprisoned in fact in the orphanage, and then "sold" to Aibi that provided to transfer them to Italy to families awaiting adoption. But none of this really happened. The Public Prosecutor's Office ordered the filing "due to the groundlessness of the crime report".

The news takes on a significance that goes beyond the dispute between Cai's past management and the Aibi. It marks the end of a long period that has seen heavy shadows lengthen over the entire system of adoptions, when a crisis of confidence was added to the general collapse of the arrival of children in Italy, but also in the West, which undermined the credibility of the institutions , the relationships with adoptive families, the long-established collaboration between juvenile courts and central control body (precisely the Cai).

"The end of a nightmare that has upset our lives for almost six years. And it has made it almost impossible for us to work and for our families to continue the adoptive path in a serene way. But do we realize what it means for an institution that deals with international adoption to go ahead with the suspicion of stealing children, of buying them in Africa and then reselling them in Italy? ". He has the voice broken off to Marco Griffini, founder and president of Aibi, while commenting on the decree of archiving of the Court of Milan that on March 5 last dissolved all doubts. In the 600 pages of accusations put together by the previous Cai manager, Silvia Della Monica, against Aibi, there is no news of a crime.

A confirmation of what Aibi has always maintained and what the authorities of the Congo have said immediately: no irregularities. Why was all this time necessary to arrive at the truth?

Those who know us knew very well what our role was, who has a minimum knowledge of the world of adoptions knows very well that they are practices not only ethically unimaginable but also concretely impossible. But against us there was the Commission for international adoptions, that is the State, even if it was the former manager. Now we have solved everything.

How did this story begin?

Already in December 2014, the vice president of Cai presented to us a complaint to the Public Prosecutor's Office of Rome and presented it again in February 2015. However, no investigation was started. Some months before leaving the vice presidency of the Cai, Silvia Della Monica put together a dossier of over 600 pages, it was February of 2017, and at this point the Court of Rome passed everything to Milan for competence.

What are the charges?

A very long series of criminal offenses: from the mistreatment of minors to illegal immigration. But the investigations have led to nothing. The desire to archive has emerged immediately. But the fundamental verification was carried out on the administrative acts carried out by the Cai itself that among its powers has that of sanctioning and even suspending the institutions. Well, despite the fact that he had set up all those criminal charges against us, from an administrative point of view Cai has never moved us any notes.

In short, has the Aibi been never prevented from continuing to assist families who wanted to adopt a child?

Exact. And the magistrates pointed out the inconsistency. If we had really collected all those crimes, it would have been urgent to suspend our activity. But Cai has never done this ".

What was the idea of this whole story?

I really don't know. Many hypotheses have been made but everything seems absurd. It is said that there was a project to wipe out the whole world of adoptions. But these are things that do not stand. We have been dealing with adoptions for 40 years. We have worked well with hundreds and hundreds of families who keep us friendship and gratitude. We are especially happy for them and for all couples who can continue to look at adoption as a possible path. Let's move forward with confidence. No one has stolen the children. "

Adozioni, adesso la lunga stagione dei veleni è ufficialmente finita. La Procura di Milano ha definitivamente archiviato il procedimento avviato dalla precedente gestione della Cai (Commissione adozioni internazionali) ai danni di Aibi, uno dei più importanti enti autorizzati per le adozioni, per una serie di gravi irregolarità riguardanti le procedure di adozioni in Congo. In pratica Aibi era accusata di ottenere il via libera alle adozioni dalle autorità del Paese africano dietro il pagamento di tangenti.

I minori, secondo gli addebiti mossi dalla Cai all’ente milanese, sarebbero stati sottratti alle famiglie di origine, imprigionati di fatto nell’orfanotrofio, e poi “venduti” ad Aibi che provvedeva a trasferirli in Italia alle famiglie in attesa di adozione. Ma nulla di tutto questo è realmente accaduto. La Procura ha ordinato l’archiviazione “per infondatezza della notizia di reato”.

La notizia assume un rilievo che va al di là del contenzioso tra la passata gestione della Cai e l’Aibi. Segna la fine di un lungo periodo che ha visto ombre pesanti allungarsi sull’intero sistema delle adozioni, quando al crollo generalizzato degli arrivi dei bambini in Italia, ma anche in Occidente, si è aggiunta una crisi di fiducia che ha minato la credibilità degli enti, i rapporti con le famiglie adottive, la collaborazione da tempo rodata tra tribunali minorili ed ente di controllo centrale (appunto la Cai).

«La fine di un incubo che da quasi sei anni ci ha sconvolto la vita. E ha reso quasi impossibile a noi lavorare e alle nostre famiglie proseguire in modo sereno il percorso adottivo. Ma ci rendiamo conto cosa significa per un ente che si occupa di adozione internazionale andare avanti con il sospetto di rubare i bambini, di comprarli in Africa per poi rivenderli in Italia?». Ha la voce spezzata Marco Griffini, fondatore e presidente di Aibi, mentre commenta il decreto di archiviazione del Tribunale di Milano che il 5 marzo scorso ha dissolto ogni dubbio. Nelle 600 pagine di accuse messe insieme dalla precedente responsabile della Cai, Silvia Della Monica, nei confronti di Aibi, non c’è nessuna notizia di reato.

Una conferma di quanto Aibi ha sempre sostenuto e di quanto hanno raccontato da subito le autorità del Congo: nessuna irregolarità. Come mai è stato necessario tutto questo tempo per arrivare alla verità?

Chi ci conosce sapeva benissimo qual è stato il nostro ruolo, chi ha una minima conoscenza del mondo delle adozioni sa benissimo che sono pratiche non solo eticamente inimmaginabili ma anche concretamente impossibili. Però contro di noi c’era la Commissione per le adozioni internazionali, cioè lo Stato, anche se si trattava dell’ex responsabile. Ora abbiamo risolto tutto.

Come è iniziata questa vicenda?

Già nel dicembre 2014 la vicepresidente della Cai ha presentato nei nostri confronti un esposto alla Procura di Roma e l’ha ripresentato nel febbraio del 2015. Però non è stata avviata alcuna indagine. Alcuni mesi prima di lasciare la vicepresidenza della Cai, Silvia Della Monica ha messo insieme un dossier di oltre 600 pagine, era il febbraio del 2017, e a questo punto il Tribunale di Roma ha passato tutto a Milano per competenza.

Con quali accuse?

Una serie lunghissima di reati penali: dal maltrattamento di minori all’ immigrazione clandestina. Ma le indagini non hanno portato a nulla. E’ emersa da subito la volontà di archiviare. Ma la verifica fondamentale è stata fatta sugli atti amministrativi compiuti dalla Cai stessa che tra i suoi poteri ha quello di sanzionare e anche di sospendere gli enti. Ebbene, nonostante avesse messo in piedi tutte quelle accuse penali nei nostri confronti, dal punto di vista amministrativo la Cai non ci ha mai mosso alcun appunto.

Insomma, all’Aibi non è mai stato impedito di continuare ad assistere le famiglie che volevano adottare un bambino?

Esatto. E i magistrati hanno sottolineato l’incongruenza. Se davvero avessimo collezionato tutti quei crimini, sarebbe stato urgente sospendere la nostra attività. Ma questo la Cai non l’ha mai fatto”.

Che idea si è fatto di tutta questa storia?

Non saprei davvero. Si sono fatte tante ipotesi ma tutto appare assurdo. Si dice che ci fosse un progetto per azzerare tutto il mondo delle adozioni. Ma sono cose che non stanno in piedi. Ci occupiamo di adozioni da 40 anni. Abbiamo lavorato bene con centinaia e centinaia di famiglie che ci conservano amicizia e gratitudine. Siamo contenti soprattutto per loro e per tutte le coppie che potranno continuare a guardare all’adozione come percorso possibile. Andiamo avanti con fiducia. Nessuno ha rubato i bambini”.
