Adoption of stepchildren - even without a marriage certificate

So far it was not possible to adopt as a couple without marriage certificate the child of the partner. This is unconstitutional, decided now the Federal Constitutional Court.

If a man or a woman wants to adopt the partner's children, this is only possible under the law if both are married. For unmarried couples living in a non-marital partnership, it is not yet possible to adopt stepchildren. The Federal Constitutional Court considers this unconstitutional. This violates the fundamental right of children to equal treatment.

Important for personal development

According to the judges, every family is under special protection - including the stepchild family. It is important for the personal development of a child to be adopted. The fact that children are disadvantaged in the adoption, just because the parents are not married, is not justified.

In addition, one must take into account that the non-marital family in recent years, in addition to the marital family more and more established in society. In the specific case, a man wanted to adopt the children of his partner, which was denied him. On the other hand, the Federal Court of Justice had rejected a legal complaint two years ago.

The law now needs to be changed by March 31, 2020.

Will ein Mann oder eine Frau die Kinder des Partners adoptieren, ist das nach dem Gesetz bisher nur möglich, wenn beide verheiratet sind. Bei unverheirateten Paaren, die in einer nichtehelichen Lebensgemeinschaft leben, ist es bisher nicht möglich, Stiefkinder zu adoptieren. Das Bundesverfassungsgericht hält das für verfassungswidrig. Dies verstoße gegen das Grundrecht der Kinder auf Gleichbehandlung.

Wichtig für persönliche Entwicklung

Nach Ansicht der Richter stehe jede Familie unter einem besonderen Schutz - auch die Stiefkindfamilie. Für die persönliche Entwicklung eines Kindes sei es dabei wichtig, adoptiert werden zu können. Dass Kinder bei der Adoption benachteiligt würden, nur weil die Eltern nicht verheiratet sind, sei nicht gerechtfertigt.

Außerdem müsse man berücksichtigen, dass sich die nichteheliche Familie in den vergangenen Jahren neben der ehelichen Familie immer mehr in der Gesellschaft etabliert habe. Im konkreten Fall wollte ein Mann die Kinder seiner Lebensgefährtin adoptieren, was ihm verwehrt wurde. Eine Rechtsbeschwerde dagegen hatte der Bundesgerichtshof vor zwei Jahren zurückgewiesen.

Das Gesetz muss nun bis zum 31. März 2020 geändert werden.
