Consultation of Dutch distance files with retroactive effect free of charge for adopted persons
On September 30, 2019, Minister Dekker (Legal Protection) announced that access to Dutch distance files should be free of charge for adopted persons. Adopted persons who have incurred costs in the past to view the waiver file or to obtain pedigree data from the file, can reclaim the amount paid by them.
In his speech, held during the Start Conference on 'In-depth research into distance parents and distance children', Minister Dekker said that the Ministry of Health, Welfare and Sport is contributing to the financing of both access to distance files and financing for search actions by Fiom. This contribution from the Ministry of Health, Welfare and Sport means that inspection of Dutch distance files can take place free of charge. For searches, the minister refers to the institutional subsidy that Fiom already receives. The personal contribution for national searches (€ 85) remains.
Right to pedigree information
Adopted persons do not automatically have the right to inspect the distance file. The waiver file is the property of the waiver mother (the woman who has renounced her child). He must therefore give permission for inspection. The distance file not only contains information about the child's descent, but also displays the feelings and considerations of the distance mother. This information is often very personal.
If the distance mother does not give permission for inspection, the child can usually receive pedigree data from the file. The right to this data is not absolute: if the distance mother has compelling interests that outweigh the interest of the child in obtaining descendants data, the child will not receive descendants data. Usually, the interests of the surrendered child outweigh the interests of the mother, so that the non-acquisition of pedigree data is only very sporadic.
Reimbursement of costs incurred for file inspection
Have you seen a distance file at Fiom? Then you can reclaim the amount you paid via the form on the Fiom website. You are hereby requested to enclose proof of your payment, for example the invoice that you have received from Fiom or a representation of your transfer.
Have you viewed a remote file at another agency? Then you can contact the relevant authority. The Ministry of Health, Welfare and Sport will come into contact with bodies that manage remote files.

Op 30 september 2019 heeft minister Dekker (Rechtsbescherming) laten weten dat inzage in Nederlandse afstandsdossiers kosteloos zou moeten zijn voor geadopteerden. Geadopteerden die in het verleden kosten hebben gemaakt om het afstandsdossier in te zien of afstammingsgegevens uit het dossier te verkrijgen, kunnen het door hen betaalde bedrag terugvragen.
In zijn toespraak, gehouden tijdens de Startconferentie 'Verdiepend onderzoek naar afstandsouders en afstandskinderen', geeft minister Dekker aan dat het ministerie van Volksgezondheid, Welzijn en Sport bijdraagt aan de financiering van zowel inzage in afstandsdossiers als aan financiering voor zoekacties door Fiom. Deze bijdrage van het ministerie van VWS betekent dat inzage in Nederlandse afstandsdossiers gratis kan plaatsvinden. Voor zoekacties doelt de minister op de instellingssubsidie die Fiom reeds ontvangt. De eigen bijdrage voor nationale zoekacties (€ 85,-) blijft bestaan.
Recht op afstammingsgegevens
Geadopteerden hebben niet zonder meer recht op inzage in het afstandsdossier. Het afstandsdossier is eigendom van de afstandsmoeder (de vrouw die afstand heeft gedaan van haar kind). Deze moet daarom toestemming voor de inzage geven. Het afstandsdossier bevat niet alleen informatie over de afstamming van het kind, maar ook weergaven van de gevoelens en overwegingen van de afstandsmoeder. Deze informatie is vaak zeer persoonlijk.
Wanneer de afstandsmoeder geen toestemming geeft voor inzage, kan het kind doorgaans wel afstammingsgegevens uit het dossier ontvangen. Het recht op deze gegevens is niet absoluut: wanneer de afstandsmoeder zwaarwegende belangen heeft die zwaarder wegen dan het belang dat het kind heeft op het verkrijgen van afstammingsgegevens, zal het kind geen afstammingsgegevens ontvangen. Meestal wegen de belangen van het afgestane kind zwaarder dan de belangen van de moeder, waardoor het niet verkrijgen van afstammingsgegevens slechts zeer sporadisch voor komt.
Terugbetaling gemaakte kosten voor dossierinzage
Heb jij een afstandsdossier ingezien bij Fiom? Dan kun je via het formulier op de website van Fiom het door jou betaalde bedrag terugvragen. Je wordt hierbij verzocht bewijs van jouw betaling bij te voegen, bijvoorbeeld de nota die je van Fiom hebt ontvangen of een weergave van jouw overboeking.
