Pforzheim/Enzkreis. A scenario that repeats itself: In the trial in which a defendant from the Enz district has to answer in court for defamation against Oana Krichbaum, judge Stefan Bien again fails to pass judgment. Too many applications from defender Hubert Gorka still have to be processed.
This time the atmosphere in the courtroom is once again charged with emotion. And one thing runs like a red thread through to the last day of negotiations. Again she screams, again she has to be admonished and again she interrupts others: The accused (50), whom the Pforzheim lawyer Oana Krichbaum is said to have described on the Internet platform Facebook, among other things, as a child trafficker.
Before even thinking about pronouncing a verdict, a rare picture appears: public defender Susanne Burkhardt applies for a release from her mandate. Not only does she seem to be at the breaking point, she also says it quite explicitly: "I have panic attacks when I open my e-mail program," says the lawyer. Because: The accused is now not only terrorizing the Krichbaum family with threats and insinuations in emails, but also the judge and even her as a defense attorney.
"The procedure has become unbearable for me," says Burkhardt , who is considering filing a criminal complaint against the accused.
The court does not agree to the request. The reason: defender Hubert Gorka was not present every day, so the procedure would have to be started again.
But there is now an end to the process in sight anyway: Because the judge is dedicating himself to the last remaining pieces of the puzzle in the taking of evidence. First, a Romanian and French article will be read, in which illegal adoptions will be discussed. These are associated with the wife of the CDU member of the Bundestag. Yes, the articles would be full of mistakes, says co-plaintiff Bastian Meyer. This can be proven, for example, by the fact that Oana Krichbaum is assigned political functions that she never held. A report will also be read out by parents who probably adopted two children from Oana Krichbaum's earlier foundation and who speak of an "involuntary donation" in this context. And the curious thing about it: Again you get away from the actual subject of the negotiation. Especially when the defendant claims that the son of the Krichbaum family threatened her. Meyer: "This is the next slander" and a clear "perpetrator-victim reversal".
Prosecutor Gerrit Schwedler and co-plaintiff Bastian Meyer basically agree on the pleadings, in that they plead for eight months imprisonment without probation. Schwedler explains that the accused not only distributed articles to which she referred, but also drew her own conclusions that went far beyond that. Also because the verdict from the first instance – a prison sentence of six months on probation – does nothing for her. Meyer again emphasizes that the newspapers or blogs with the supposed facts have an "underground level" and that there is no evidence of child trafficking in relation to Oana Krichbaum. During the course of the trial, she fought back tears, which made it clear how much she suffered from the defamation that the accused was still making up to this day of the trial.
Meyer puts it so succinctly that the defendants' purpose in life is "to harass and terrorize."
For defender Hubert Gorka, on the other hand, the process can only have one result: acquittal. In his almost two-hour plea with innumerable requests for help - in which he requested, among other things, that adoptive parents and various people who had something to do with the adoptions be invited - he repeatedly emphasized that his client only reproduced what was in newspaper articles.
